If you are planning to submit a citizenship by descent application to the Canadian government, there is one document that can greatly help your case.

A cover letter may not be listed in the document checklist, but there are some scenarios where submitting one is highly recommended.

We asked Reena Sandhu, an immigration lawyer at Cohen Immigration Law, to explain what this document is and when you need it as part of your application.

What is a cover letter for proof of Canadian citizenship applications?

A cover letter lets the applicant explain the purpose of the application, outline their scenario, provide details about their Canadian ancestor, list the documents included, and flag any facts or circumstances that aren't obvious from the rest of the package

A cover letter is optional in straightforward cases. If an applicant, their parent, or grandparent was born in Canada, and every document on the checklist is present and accounted for, without any spelling or date variances, there is no need for one.

However, in scenarios where necessary documentation – such as birth certificates in the Canadian lineage – is missing, it becomes mandatory. It is also strongly recommended for any multi-generation file. The more generations between the applicant and their Canadian ancestor, the more names, dates, and documents an officer has to piece together. A cover letter connects the dots in such cases.

Wondering if your situation requires a cover letter? Ask yourself the following questions, then look through your documentation and check whether your application already answers them:

·                   Does your ancestor's name appear the same way on every record?

·                   Do the dates line up, or does a birth year shift between documents?

·                   Is any document in the chain missing entirely?

·                   How many generations separate you from your Canadian ancestor?

·                   Do you know how that ancestor became Canadian — born there, or naturalized?

What should be in a cover letter?

A cover letter should give the officer reviewing the file everything they need to understand the claim at a glance, rather than making them reconstruct it from the documents alone.

In general, it should identify:

·                   The applicant, the scenario and the generation profile (their relationship to the Canadian ancestor, including how many generations separate them);

·                   The "anchor" ancestor, meaning the person whose Canadian citizenship the whole claim rests on, and the basis for that person's status;

·                   Any name discrepancies, date gaps, or conflicting records across the documents;

·                   Any missing documents, along with the substitute documents being relied on in their place; and

·                   Whether urgent processing is being requested, and why.

The clearer the lineage is mapped out on paper, from the applicant back to the Canadian ancestor, the easier the file is for the officer assessing it, and that clarity works in the applicant's favour.

If you have hired a licensed immigration lawyer or consultant, their team will draft the cover letter. A lawyer will then review the document alongside the complete application, and provide feedback on important points that must be included.

Why having a cover letter can help your case

An officer assessing your file has to trace an unbroken line from you back to your Canadian ancestor. This includes verifying the names, dates, places, and the relationship between each generation.

When a document is missing, the officer doesn't know whether it was destroyed, never existed, or simply wasn't sent. When a name changes between records, they don't know whether it's the same person. Left unexplained, those look like unresolved questions rather than ordinary clerical variation.

Having it all listed out, in a straightforward manner, helps the officer connect the dots.

Is a cover letter the same as a no-record letter?

No. A no-record letter is a letter from an original source authority (such as a vital statistics office or an archive) confirming that they looked for specific documentation you’ve requested and found nothing within the years and place you specified.

A cover letter is written to explain the applicant's lineage, the basis of their status, and other necessary details.

Where there are gaps in the documentation, both a cover letter and a no-record letter may work well together: the no-record letter proves that the original source authority could not locate the record, and the cover letter explains what that means for the applicant's case and how the gap is being bridged.

Is a cover letter the same as a letter of explanation?

IRCC states that you must provide a letter of explanation (LOE) for any necessary documents that are missing, not included, or require further clarification.

An LOE is different from a cover letter, which provides a more holistic view of the applicant’s situation, although these two documents may be interconnected; parts of an LOE may be included or mentioned in a cover letter as well.

LOEs can be submitted for situations such as:

·                   To describe the attempts made by an applicant to locate mandatory documents that do not exist;

·                   Discrepancies in files, such as different name spellings, variants in birth years in different documentations, etc; and

·                   When there is a minor child with only one piece of ID as part of the application package.

Keep in mind that these are not an exhaustive list of situations wherein an applicant may need to include an LOE. There are a variety of other possible scenarios.
