Appeal denied for family seeking OHIP reimbursement after twin birth at Cambridge Memorial

A woman who didn't become eligible for OHIP until almost a month after her twin daughters were delivered by Caesarian section at Cambridge Memorial Hospital, won't be getting reimbursed for health care costs.

The Health Services Appeal and Review Board decided earlier this month not to grant a review of the woman's OHIP eligibility.

The decision was posted today on CanLII, a website of Canadian legal cases. 

As a spouse of a temporary foreign worker, the woman became eligible for OHIP the day her husband met eligibility requirements.

That was June 11, 2024, close to a month after their twins were born.

The physician who performed the delivery invoiced the family $5,424 the same day, May 13, 2024.

Temporary foreign workers are eligible for OHIP once they provide a valid work permit or other document issued under the Immigration and Refugee Protection Act, which permits the person to work in Canada.

They must also have a formal agreement in place to work full-time for an employer for at least six consecutive months and be working under that agreement.

Since the husband's work start date was after his wife gave birth, she was ineligible for coverage.

The OHIP Eligibility Review Committee made its decision on the matter on May 21, 2025.

The review board held up that decision by dismissing the appeal after a hearing last month.

Neither the Health Insurance Act nor the regulation defining eligibility includes a provision that would permit OHIP to declare a person to be resident or declare a resident to be eligible for health insurance coverage on the basis of compassion or financial hardship, reads the decision.
